Unapproved Record – The Board of County Commissioners, Platte County, Wyoming, met on the 21st day of May 2024 in the county seat of Wheatland. Those present for the meeting were Steve Shockley, Commission Chairman; Ian Jolovich, Commissioner; Kayla Mantle, Commissioner; and Malcolm Ervin, County Clerk. Chairman Shockley called the meeting to order at 9:00 AM. Commissioner Jolovich motioned, seconded by Commissioner Mantle, to approve the agenda as presented. The motion carried. Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve the May 7th meeting minutes. The motion carried. Encroachment License: The Board reviewed, and approved, an encroachment license request made by Bill Klein. County Treasurer: The Board reviewed the daily receipts of Treasurer Kristi Rietz from May 3 through May 16, 2024, which totaled $851,158.14. Treasurer Rietz also presented the fiscal position of the County as of April 30, 2024. FY24-25 Budget: Pursuant to W.S. §16-4-104(a), Clerk Ervin filed the recommended budget for Fiscal Year 2024 – 2025 with the Board on May 15th. Combat Veterans Motorcycle Association: Kelly Mixson spoke to the Board regarding a flag retirement ceremony that will be performed by the Combat Veterans Motorcycle Association. The ceremony will take place on June 14th from 5:00 – 6:00 PM at the Hub City Campground in Guernsey. Maintenance Department: Jim DeWitt, Maintenance Supervisor, presented two quotes to the Board. The Board authorized Mr. DeWitt to proceed with the two quotes. Executive Session: At 11:15 AM, Commissioner Jolovich motioned, seconded by Commissioner Mantle, to call for an executive session for personnel matters pursuant to W.S. §16-4-405(a)(ii). The motion carried. At 11:33 AM, Commissioner Jolovich motioned, seconded by Commissioner Mantle, to adjourn executive session where no decisions were made. The motion carried. Land Use Complaint: Don Canaday presented a land use complaint to the Board for a property located at 1835 Highway 26, Guernsey. The Board directed Doug Dumont, County Planner, to investigate the complaint and issue a report to the Board. Plat Map Approval: The Board reviewed, and approved, the final plat for the Hefner Simple Subdivision. Public Hearing – Planning & Zoning: Chairman Shockley called a public hearing to order at 10:00 AM for the purpose of accepting public comment on a Simple Subdivision request and three Special Use Permit requests. Planner Dumont presented the Simple Subdivision request made by Rod & Trish Vineyard. The request is to subdivide approximately 12.36 acres out of a 225.17 parcel described as part of the NE ¼ NE ¼ of Section 17, Township 24 North, Range 67 West, otherwise known as 69 East Oak Road. Planner Dumont informed the Board the request was recommended for approval by the Planning & Zoning Commission on May 14, 2024. Chairman Shockley opened the meeting to public comments, but none were received. Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve the Simple Subdivision request as presented. The motion carried. Planner Dumont then presented three Special Use Permit requests made by Cheyenne Light, Fuel & Power Company who are requesting to build approximately 76 miles of electrical transmission lines. The applicants submitted three applications: one application covering approximately 24 miles through the southern portion of the County; the second covering approximately 29 miles through the middle of the County; and the third covering approximately 23 miles through the north and northwest portion of the County. Pre-construction for the project is scheduled to begin in May of 2024, with an estimated completion by April of 2026. The requests were recommended for approval, with seven stipulations, by the Planning & Zoning Commission on May 14, 2024. Chairman Shockley opened the meeting to public comments. Helen Bauer asked if the applicant changed their route would the request have to be reviewed by the Board again. The Board informed Mrs. Bauer the applicant would need to come back to the Board if their request changed, which is why the applicant separated the project into three requests rather than one larger request. The Board then asked a series of questions to the applicants. Chairman Shockley asked whether stipulation number one would require the applicant to submit a reclamation and weed management plan to become part of the file. Randy Harris, Director of Land for Black Hills Energy, said they would ensure those reports were provided to Planner Dumont. The Board also asked whether there were reclamation and decommissioning plans. Mr. Harris said the Public Service Commission largely focuses on reclamation and as such an “asset retirement account” had been created for the purpose of removal of infrastructure and reclamation. Mr. Harris further stated Black Hills Energy had reviewed the seven stipulations recommended by the Planning & Zoning Commission and agreed they would be able to comply with those stipulations. Commissioner Jolovich then expressed his concern about the use of county roads beyond their normal and customary traffic, he further expressed his desire that a road use agreement be entered into. Mr. Harris informed the Board of Black Hills Energy’s general practice regarding County roads, which is to repair damage caused by their construction activities. The Board agreed that an eighth stipulation should be added to require a road use agreement. Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve special use permit requests A, B and C made Cheyenne Light, Fuel & Power Company with eight stipulations. The motion carried. FY23-24 Audit: Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve the audit engagement letter between Leo Riley & Co. & Platte County for Fiscal Year 2023 – 2024. The motion carried. Agreements: Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve two Public Health grant agreements as presented. The motion carried. Circuit Court Magistrate: Kate Fox, Chief Justice of the Wyoming Supreme Court, informed the Board that Magistrate Scott Cole has announced his retirement and that the Supreme Court believed a part-time magistrate was warranted to continue a judicial presence in Platte County. Circuit Court Judge Nathaniel Hibben informed the Board that he will begin the process of appointing a part-time magistrate who will need to be approved, or rejected, by the Board. Appointment of Special Prosecutor: Commissioner Mantle motioned, seconded by Commissioner Jolovich, to approve Resolution #2024-10 appointing a special prosecutor. The motion carried.
