UNAPPROVED RECORD OF PROCEEDINGS FOR THE GOVERNING BODY OF THE

TOWN OF WHEATLAND A regular meeting of the Council for the Town of Wheatland, Platte County, and State of Wyoming was held on Monday, November 14, 2022, pursuant to the law.
Mayor Graves called the meeting to order at 7:00 p.m. The following were present at roll call: Councilman Britz, Race, Madsen, and Montoya. Clerk/Treasurer Candy Wright and Attorney Doug Weaver were also present. Mayor Graves presented the agenda with an addition to new business, appointment of Justin Brennan to Board of Adjustments. Councilman Britz motioned, seconded by Councilman Montoya, to accept the agenda with noted changes. Motion passed 4-0.
Councilman Montoya motioned, seconded by Councilman Race, to accept the consent agenda as presented and to place it on file. Motion passed 4-0. Mayor Graves recognized John Thomas as the Town of Wheatland’s Apprentice Lineman.  Jeff Brown with PCED introduced new director Tracy DeRyk. Additional concerns were received on the topic of the stop sign at Oak and 16th Street.     UNFINISHED BUSINESS: Councilman Britz motioned, seconded by Councilman Madsen, to approve Ordinance 838 on third and final reading. Motion passed 4-0. ORDINANCE NO. 838 AN ORDINANCE REZONING 754 COLE STREET, TOWN OF WHEATLAND, MORE PARTICULARLY DESCRIBED AS SHOWN BELOW WHEREAS, the applicants, Anthony and Lacy Mansfield, submitted an application for a land use district boundary change for the real property described below, and; WHEREAS, the Planning and Zoning Commission held a public hearing concerning this land use district boundary change on September 1, 2022, and; WHEREAS, during the September 1, 2022, Planning and Zoning Commission public hearing the Commission voted to recommend to the Town Council to approve the requested land use district boundary change from Conservancy District to Residential District, and; NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WHEATLAND, WYOMING: The following described real property: EXHIBIT “A” Beginning at the Southeast corner of the SW¼SE¼ of Section 13, Township 24 North, Range 68 West;  thence N88°22’W., along the South line of the SE¼ of Section 13, for a distance of 580.41 feet to the Southwest corner of the property described in Book 80, Page 173, in the Platte County Clerk’s Office and which point is 742.34 feet, S88°22’E., from the South ¼ corner of Section 13 and which point is the TRUE POINT OF BEGINNING;  thence N00°03’52”E., along the West boundary of the property described in Book 80, Page 173, and parallel with the East line of the SW¼SE¼, for a distance of 464.24 feet;  thence N63°29’E., for a distance of 55.90 feet;  thence S00°03’52”W., parallel with the East line of the SW¼SE¼, for a distance of 490.96 feet to a point on the South line of the SW¼SE¼, Section 13;  thence N88°22’W., for a distance of 50.00 feet to the TRUE POINT OF BEGINNING. EXCEPTING THEREFROM THE FOLLOWING TWO TRACTS: The following described portion of the SW¼SE¼ of Section 13, Township 24 North, Range 68 West of the 6th P.M., Platte County, Wyoming.  Beginning at a point which point is on the South line of the SE¼ of said Section 13 and is N.88°22’W., a distance of 2428.35 feet from the SE corner of said Section 13;  thence N.13°30’00”E., along the Westerly boundary of the property described in Book 131, Page 397, a distance of 288.35 feet;  thence S.82°12’43”E., a distance of 122.43 feet;  thence S.15°16’46”W., a distance of 256.30 feet to the North right-of-way line of the Cole Street road;  thence S.01°38’00”W., a distance of 20.00 feet to the South line of Section 13;  thence N.88°22’00”W., along the South line of Section 13, a distance of 120.55 feet to the point of beginning. Be and the same is hereby re-zoned from Conservancy District (C) to Residential District (R) as set forth in Title 18 of the Wheatland Municipal Code. Passed and approved this 12th day of September 2022, on first reading.  Passed and approved this 10th day of October 2022, on second reading. S/N:  Mayor Brandon Graves Attest:  S/N:  Clerk Candy Wright NEW BUSINESS: Councilman Britz motioned, seconded by Councilman Race, to accept the insurance renewal from Woolington Agency.  Motion passed 4-0.  Councilman Race motioned, seconded by Councilman Montoya, to accept the agreement with Superior Contacting for the storm drain work east of the Middle School and authorize the Mayor to sign.  Motion passed 4-0.  Councilman Britz motioned, seconded by Councilman Montoya, to accept the re-plat of the Joe Johnson subdivision and the acceptance of Hope Street and Faith Street.  Motion passed 4-0.  Councilman Montoya motioned, seconded by Councilman Race, to Mayor’s appointment to appoint Justin Brennan to the Board of Adjustments.  Motion passed 4-0.  At 8:33 p.m. Councilman Montoya motioned, seconded by Councilman Race to adjourn into executive session for the purpose of a discussion on litigation. Motion passed 4-0.  Council adjourned out of Executive Session at 9:15 p.m.  Council authorized a course of action for the scheduled December 6, 2022, mediation.  Council resumed discussion on the stop sign at 16th Street and Oak.  With nothing further to come before the Council the meeting adjourned 9:25 p.m. S/N:  Mayor Brandon Graves Attest:  S/N:  Clerk Candy Wright
