TOWN OF WHEATLAND A regular meeting of the Council for the Town of Wheatland, Platte County, and State of Wyoming was held on Monday, November 08, 2021, pursuant to the law. 

Mayor Graves called the meeting to order at 7:00 p.m. The following were present at roll call: Councilmen Madsen, Montoya, Race and Britz. Clerk/Treasurer Candy Wright and Attorney Doug Weaver were also present. Mayor Graves presented the agenda adding Platte County Building Permit Fees to Public Comment and move the Fire Department Agreement to Unfinished Business. Councilman Montoya motioned, seconded by Councilman Race, to accept the agenda as amended. Motion passed 4-0. Councilman Montoya motioned, seconded by Councilman Madsen, to accept the consent agenda as presented and to place it on file. Motion passed 4-0. Councilman Madsen motioned, seconded by Councilman Race, to reduce the building permit fees to $4,000 as the base amount and $60.00 per hour for inspection time not to exceed $14,000.00. Motion passed 4-0. UNFINISHED BUSINESS: Councilman Britz motioned, seconded by Councilman Race, to accept the Ambulance Lease Agreement with Banner Health with noted changes to pages 2, 4, and 6.  Motion failed 2-3 with Mayor Graves, Councilman Montoya, and Councilman Madsen voting no. Councilman Race motioned, seconded by Councilman Montoya to approve the updated agreement with Inberg-Miller and authorize the Mayor to sign. Motion passed 4-0. Councilman Madsen motioned, seconded by Councilman Montoya, to approve, on third and final reading Ordinance 832. Motion passed 4-0. The ordinance follows in its entirety. AN ORDINANCE APPROVING THE ANNEXATION OF THE PARAGON PARK ADDITION TO THE TOWN OF WHEATLAND, WYOMING ESTABLISHING ZONING CLASSIFICATION FOR SAID PROPERTY  WHEREAS, Paragon Park, a Wyoming limited liability company, authorized agent for property owner Cynthia Hilty, has submitted a petition for annexation of the real property more specifically described in Exhibit A attached hereto (the “Property”); and WHEREAS, the petitioner has requested to zone the above-described property Highway Business District; and WHEREAS, a petition requesting annexation has been signed by Cynthia Hilty, sole landowner of the property sought to be annexed and submitted said petition to the Town of Wheatland Clerk for approval pursuant to W.S. § 15-1-403, as amended; and WHEREAS, an annexation report has been completed in accordance of W.S. § 15-1-402, as amended; and WHEREAS, the Town of Wheatland Planning and Zoning Commission recommended to the Town Council for the Town of Wheatland approve the annexation and the zoning of the Property as described above following a public hearing on August 5, 2021; and WHEREAS, the annexation of the area is for the protection of the health, safety and welfare of the persons residing in the area and in the Town of Wheatland; and WHEREAS, the commercial development of the area sought to be annexed would constitute a natural, geographical, economic and social part of the annexing of Town of Wheatland; and WHEREAS, the Property sought to be annexed is a logical and feasible addition to the annexing Town of Wheatland and that the extension of basic services, such as the water system, wastewater system, electrical system, police and fire protection, and other services customarily available to businesses of the Town of Wheatland can reasonably be furnished to the area proposed to be annexed; and WHEREAS, the Property sought to be annexed is contiguous with and adjacent to the annexing Town of Wheatland; and WHEREAS, the Wheatland Town Council held a Public Hearing on August 9, 2021, in the Town of Wheatland Council Chambers at 7:00 pm and determined that the proposed annexation complies with W.S. § 15-1-402.  NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WHEATLAND, WYOMING, that:  Section 1:  The annexation of Property described herein is hereby approved and below in accordance with Wyoming state law, as amended; and the Town of Wheatland Municipal Code and is hereby included within the corporate limits of the Town of Wheatland and all rights, privileges and duties pertaining to such inclusion shall apply to said development. Property described as that parcel of land described in Book 527 at Page 576 in the office of the Platte County Clerk, being located within the NW1/4SW1/4 of Section 12, Township 24 North, Range 68 West, 6th P.M., Platte County, Wyoming, being more particularly described as follows: Beginning at the northwest corner of said NW1/4SW1/4 of Section 12; thence on and along the north line of said NW1/4SW1/4, S88°42’21”E, 822.09 feet, more or less, to the Northeast corner of said parcel; thence on and along the East line of said parcel, S00°23’36”E, 443.25 feet, more or less, to the Southeast corner of said parcel; thence on and along the South line of said parcel, N88°43’16”W, 821.73 feet, more or less, to the Southwest corner of said parcel and West line of said NW1/4SW1/4; thence on and along said West line N00°26’18”W, 443.48 feet, more or less to the point of Beginning; said parcel containing 8.36 acres, more or less. Section 2:  The Town’s zoning map shall be amended to reflect the zoning of the Property as Highway Business. Section 3:  This ordinance shall, pursuant to W.S. § 15-1-408, be in full force and effect on the 21st business day following the third reading approval by the Town Council of the Town of Wheatland, Wyoming, and following publication. Passed and approved this 13th day of September 2021, on first reading. Passed and approved this 11th day of October 2021, on second reading. Passed and approved this 8th day of November 2021, on third and final reading. Discussion was held with comments received by the public. Councilman Madsen amended his motion to include additional changes, seconded by Councilman Britz. Motion carried. The ordinance follows in its entirety. AN ORDINANCE AMENDING WHEATLAND TOWN CODE § 9.05.090 AND § 9.05.100 CONCERNING DISCHARGE AND POSSESSION OF FIREARMS WITHIN THE TOWN OF WHEATLAND BE IT ORDAINED BY THE TOWN OF WHEATLAND, WYOMING:  Section 9.05.090 of the Wheatland Town Code is hereby amended to read as follows:  A. No person shall discharge a live round from any firearm within the limits of the Town of Wheatland. 1. “Firearms” are defined in W.S. 6-8-403 (a) (iii), and, air powered weapons capable of expelling projectiles larger than 22-caliber. 2. “Live Rounds” are those which discharge a projectile or projectiles. 3. “Blank Rounds” for the purpose of Military Honors, entertainment, public demonstrations, and in the dispersal of nuisance animals are not restricted following notification to the Town. B.  A live round may be discharged from a firearm for the reasonable and justifiable defense of personal security, personal liberty and/or private property. This is inclusive of any law enforcement officer (civil or military) in the exercise of official duty. (Reference W.S. 6-1-204) C.  Live rounds may be discharged in areas or ranges specifically zoned and constructed for the purpose of safe firearm practice, sighting, demonstrations, training and/or competition(s). Section 9.05.100 of the Wheatland Town Code is hereby repealed. Passed and approved this 13th day of September 2021 on first reading. Passed and approved this 11th day of October 2021 on second reading. Passed and approved this 8th day of November 2021 on third and final reading. S/N:  Mayor Brandon Graves Attest:  S/N:  Clerk Candy Wright   Councilman Britz provided an update on the economic health and development trends for the community.  Councilman Race motioned, seconded by Councilman Montoya, to accept the Agreement with Fire District 1F for Financing the Wheatland Volunteer Fire Department with noted changes. Motion passed 4-0.  NEW BUSINESS: Councilman Madsen motioned, seconded by Councilman Race, to renew the commercial property insurance for December 23, 2021 through December 23, 2022 with the Woolington Agency LLC. Motion passed 4-0.  Councilman Race motioned, seconded by Councilman Montoya, to approve Work Order 2021-2 for the Phifer Airfield (EAN) 2022 Seal Coat and Markings Project. Motion passed 4-0. Councilman Madsen motioned, seconded by Councilman Race, to adopt the Town of Wheatland’s Procurement Policy. Motion passed 4-0.  Councilman Race motioned, seconded by Councilman Montoya, to adjourn into Executive Session at 8:54 p.m. for legal and personnel issues pursuant to Wyoming State Statute 16-4-405 (a)(ii) and (iii).
