NOTICE OF FORECLOSURE SALE

Default having been made in the conditions of that certain Mortgage deed dated February 25, 2014, given by Stone Crazy LLC, a Limited Liability Company, to First FarmBank, to secure the payment of one certain Promissory Note of even date therewith, which Mortgage embraced the following real property to-wit:

PARCEL  I

That part of the SE¼NW¼ of Section 14, Township 24 North, Range 68 West of the 6th P.M., Platte County, Wyoming, more particularly described as follows:

Commencing at the West Quarter Corner of said Section 14; thence South 0008’35”West, along the West line of said Section 14, a distance of 431.42 feet to the westerly extension of the centerline of South Street; thence South 8957’44”East, along said westerly extension of the centerline of South Street and along the centerline of said South Street, 1483.60 feet to the West line of a tract of land described in Book 191, Page 326; thence North 0008’35”East, along said West line 470.70 feet to the True Point of Beginning; and which point is monumented with a re-bar with aluminum cap LS 601; thence from this True Point of Beginning continuing N0008’35”E 519.20 feet; thence S8957’44”E 83.94 feet on a line parallel with the centerline of South Street to the Northwest Corner of that certain tract of land described in Deed recorded in Book 116 on Page 448 in the Platte County Clerk’s Office; thence continuing on a line parallel with the centerline of South Street S8957’44”E 220.0 feet to a point on the East boundary of a 5.00 acre tract of land described in Book 116, Page 448 in the Records of Platte County; thence South on a line perpendicular to the centerline of South Street a distance of 519.00 feet to a point on the North boundary of a tract of land described in Book 260, Page 544 in the Platte County Records; thence West along said North boundary and its extension 304.9 feet to the True Point of Beginning.

That portion of the NE¼SW¼ and SE¼NW¼ of Section 14, Township 24 North, Range 68 West of the 6th P.M., Platte County, Wyoming, more particularly described as follows:

Starting at a point 350.0 feet South and 470.65 feet West of the center of Section 14, Township 24 North, Range 68 West of the 6th P.M., thence North a distance of 324.57 feet to the true point of beginning; thence North 600.00 feet;  thence South 8950’West for a distance of 251.0 feet; Thence North 4330’West for a distance of 99.13 feet; thence West a distance of 80.26 feet;  thence South for a distance of 990.0 feet; thence East for a distance of 12.0 feet; thence North for a distance of 324.57 feet; thence East for a distance of 387.50 feet to the true point of beginning.

That part of the SE¼NW¼ of Section 14, Township 24 North, Range 68 West of the 6th P.M., Platte County, Wyoming, being a part of that tract of land described in Deed recorded in Book 116, Page 448 in the records of Platte County, and being more particularly described as follows:

Commencing at the West Quarter Corner of said Section 14; thence South 0008’35”West, along the West line of said Section 14, a distance of 431.42 feet to the Westerly extension of the centerline of South Street; thence South 8957’44”East, along said Westerly extension of the centerline of South Street and along the centerline of South Street, 1483.60 feet to the West line of a tract of land described in Deed recorded in Book 191, Page 326 in the records of Platte County; thence North 0008’35” East, along said West line, 470.70 feet; thence East, 61.00 feet to the East line of said tract of land described in Book 191, Page 326; thence continuing East, 23.9 feet to the True Point of Beginning, said point being on the West line of said tract of land described in Book 116, Page 448; thence continuing East, 220.00 feet; thence South, 60.00 feet; thence West, 220.00 feet;  thence North, 60.00 feet to the True Point of Beginning.

Starting at a point on the West Section line of Section 14, Township 24 North, Range 68 West of the 6th P.M., which point is 735.00 feet South of the Northwest corner of the SW¼ of the NW¼ of said Section 14; thence going South on the West section line for a distance of 2189.00 feet, which point is the point of curve on U.S. Highway #87; thence going on a 5 curve to the right for a distance of 1800.136 feet; thence going East for a distance of 400.70 feet; thence going North for a distance of 1023.00 feet; thence going West for a distance of 1546.70 feet to the point of beginning, EXCEPT that part of the above tract lying within the following described tract:

Commencing at the West ¼ corner of said Section 14; thence South 0008’35”West, along the West line of said Section 14, a distance of 431.42 feet to the Westerly extension of the centerline of South Street; thence South 8957’44”East, along said Westerly extension of the centerline of South Street and along the centerline of South Street, as now constructed, 1483.630 feet to the West line of a tract of land described in Deed recorded in Book 191, Page 326 in the records of Platte County; Thence North 00°08’35” East, along said west line, 470.70 feet; Thence East 61.00 feet to the True Point of Beginning, said point being on the East line of said tract of land described in Book 191, Page 326; Thence East, 23.9 feet to the West line of a tract of land described in Deed recorded in Book 116, Page 448 in the records of Platte County; Thence South, along said West line, 60.00 feet; Thence West, 24.05 feet to the East line of said tract of land described in Book 191, Page 326; Thence North 0008’35”East, along said East line, 60.00 feet to the True Point of Beginning.

That part of the NE¼SW¼ of Section 14, T24N, R68W of the 6th P.M., Platte County, Wyoming, as shown in Exhibit ‘A’ – Part 2 attached hereto and being more particularly described as follows:

Commencing at the West Quarter Corner of said Section 14; thence S0008’35”W, along the West line of said Section 14 a distance of 431.42 feet to the Westerly extension of the centerline of South Street; thence S8957’44”E along said Westerly extension of South Street and along the centerline of South Street 1544.60 feet to the true point of beginning and which point is on the East boundary of a tract of land described in Book 191, Page 326; thence from this true point of beginning N0008’35”W 410.74 feet; thence East 244.01 feet to a point on the East boundary of a 5.00 acre tract of land described in Book 116, Page 448 Platte County Records; thence perpendicular to the centerline of South Street S0002’16”W 411.0 feet to the centerline of South Street; thence along said centerline of South Street N8957’44”W 245.1 feet to the true point of beginning,

also known as 2556 South Street, Wheatland, WY 82201,

which mortgage was on February 26, 2014, duly recorded at Book 486, Page 719, in the Office of the County Clerk and Ex-Officio Register of Deeds of Platte County, Wyoming. The current record owner of the property is Stone Crazy LLC, a Limited Liability Company. That the note is in default; and

WHEREAS, the default in said Mortgage has occurred by reason of the failure of the Mortgagor or assignees to pay the principal and the interest due thereon when the same became due and payable and said Mortgage contained a power of sale to the effect that a default occurring in the conditions thereof will authorize the Mortgagee or its assigns at its or their option to declare the debt secured thereby to be due and payable and proceed according to law to advertise and sell said property to satisfy the same; and

WHEREAS, no suit or proceeding has been instituted at law to recover the debt remaining secured by said Mortgage, or any part thereof, or if instituted such action has been discontinued; and First FarmBank, of 2939 65th Avenue, Greeley, CO 80634 is the owner of said Note and Mortgage; and

WHEREAS, written notice of intent to foreclose the Mortgage by advertisement and sale has been served upon the record owner and party in possession more than ten days prior to the first date of publication of this notice;

NOW THEREFORE, Notice is hereby given that the above described real property will be offered for sale and sold by the Sheriff of Platte County, Wyoming, or his Deputy, to the highest bidder for cash at public vendue at the front steps of the Platte County Courthouse, Wheatland, Wyoming, at the hour of 10:00 a.m., on September 19, 2019. However, pursuant to W.S. § 1-18-101(a)(iii), such sale shall not be held unless a representative of the Mortgagee is present. There is due and owing as of the first date of publication the sum of $1,640,791.63. Publication will be Aug. 21, 28, Sept. 4, 11, 2019. Such sum will continue to accrue interest, late charges, and any other penalties as provided by the mortgage, all to the date of sale, and additionally there shall be added to the indebtedness all costs and attorney’s fees associated with the foreclosure.

The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.
