NOTICE IS HEREBY GIVEN pursuant to WYO. STAT. §§ 34-4-101 through 34-4-113, that a certain Mortgage dated June 14, 2017, which was executed and delivered by Lana S. Shepard, Trustee for the Robert F. Shepard and Lana S. Shepard Living Trust dated November 15, 2013, Mortgagor, to Rolling Hills Bank & Trust, will be foreclosed by a sale to the highest bidder at a public auction of the premises described pursuant to a power of sale contained in the Mortgage.  If you wish to contest said sale, then you must challenge said sale by filing a lawsuit in a court of competent jurisdiction.  

The Mortgage was filed for record on June 16, 2017 as Document No. 651140 in Book 511 at Page 865, in the office of the Recorder of Deeds, Platte County, State of Wyoming.  The premises that are described in the Mortgage are as follows:

Township 24 North, Range 68 West of the 6th P.M., Platte County, Wyoming:

Section 22:  W1/2NW1/4, Excepting Therefrom that part of the NW1/4 more particularly described as follows:

Beginning at a point which is 30.0 feet South and 20.0 feet East of the Northwest corner of the NW1/4 of Section 22, Township 24 North, Range 68 West; thence running due East a distance of 208.71 feet; thence running due South a distance of 208.71 feet; thence running due West a distance of 208.71 feet; thence running due North a distance of 208.71 feet to the point of beginning.

Section 22:  E1/2NW1/4, Excepting Therefrom that part of the NW1/4 more particularly described as follows:

Beginning at a true point of beginning and which point is the N1/4 Corner of Section 22, T24N, R68W of the 6th. P.M., Platte County, Wyoming; thence from this TRUE POINT OF BEGINNING along North boundary of said Section 22; N 88°54’ W 600.00 feet; thence S01°06’00” W 40.00 feet; thence S 42°18’48” E 833.96 feet; thence N 89°59’26” E 40.00 feet to a point on the East boundary of said NE1/4NW1/4; thence N 00°03’34” W 645.20 feet along said East boundary to the true point of beginning.

Section 22:  NE1/4, Excepting Therefrom the following described three parcels:

a.  That part of the NE1/4NE1/4 Section 22 more particularly described as follows:
Beginning at the Northeast corner of Section 22, the true point of beginning; thence South, 171.5 feet along the East boundary of the NE1/4NE1/4 of Section 22, considering said South bearing as base bearing with all other bearings relative thereto; thence South 82°58’20” West, 77.8 feet; thence North 82°39’40” West, 88.3 feet; thence North 66°25’40” West, 63.3 feet; thence South 87°36’50” West, 226.6 feet to the point of beginning of a 29°15’ curve to the left; thence along said curve 187.3 feet more or less, to its point of tangency; thence South 32°49’50” West, 84.95 feet; thence South 59°36’50” West, 169.55 feet; thence South 55°20’20” West, 517.45 feet; thence North 00°41’ East, 719.0 feet to the North boundary of the NE1/4NE1/4 of Section 22; thence South 88°54’ East, 1,216.85 feet along the North boundary, to the point of beginning.

That part of the NE1/4NE1/4 of Section 22 more particularly described as follows:  Beginning at the Northeast corner of Section 22, thence South, 171.5 feet along the East boundary of the NE1/4NE1/4 of Section 22, considering the South bearing as base bearing with all other bearings relative thereto; thence South 82°58’20” West, 77.8 feet; thence North 82°39’40” West, 88.3 feet; thence North 66°25’40” West 63.3 feet; thence South 87°36’50” West, 226.6 feet to the point of beginning of a 29°15’ curve to the left, thence along the curve 187.3 feet more or less to its point of tangency; thence South 32°49’50” West, 84.95 feet; thence South 59°36’50” West, 169.55 feet; thence North 0°41’ East, 416.78 feet to the North line of the NE1/4NE1/4, Section 22; thence South 88°54’ East 794.84 feet along the North boundary to the point of beginning.

c.  That part of the W1/2NE1/4 more particularly described as follows: Beginning at the North quarter corner of Section 22; thence South 00°03’34” East, 1,519.27 feet along the West boundary of the NE1/4, with said bearing considered as base bearing, with all other bearings relative thereto; thence North 57°27’ East, 53.48 feet; thence North 52°57’ East, 257.50 feet; thence North 50°04’ East, 315.41 feet; thence North 67°38’ East, 403.94 feet; thence North 72°44’ East, 155.97 feet; thence North 77°41’ East, 168.56 feet; thence North 60°22’ East, 78.12 Feet; thence North 47°25’ East, 35.68 feet; thence North 00°41’ East, 809.55 feet to a point on the North boundary of the NE1/4; thence along the North boundary, North 88°54’ West, 1,285.26 feet to the point of beginning.

Section 22:  N1/2SE1/4 and that part of S1/2SE1/4, more particularly described as follows:

Beginning at the Southwest corner of the SE1/4 of Section 22; thence East 1,214 feet, more or less; thence North 20 feet; thence North 55°10’ East 558.2 feet; thence North 57°39’ East 420.2 feet; thence North 54°29’ East 304.3 feet; thence North 558 feet; more or less, to a point on the North boundary line of the S1/2SE1/4 of Section 22; thence West on said North boundary 2,310 feet to the Northwest corner of the S1/2SE1/4; thence South along the West boundary of the S1/2SE1/4 1,320 feet to the point of beginning.

Section 22: That part of the NE1/4SW1/4, more particularly described as follows:

Beginning at a true point of beginning and which point is the center 1/4 corner of Section 22, and which point lies SE00°03’34” 2,655.6 feet from the N1/4 corner of Section 22, and bearing considered as base bearing with all other bearings relative thereto; thence from this TRUE POINT OF BEGINNING SE00°03’34” 1,260.74 feet along the East boundary of the NE1/4SW1/4; thence NW89°05’58” 388.10 feet along a fence; thence continuing along a fence NW28°27’27” 533.51 feet; thence continuing along a fence NW06°41’50” 593.25 feet; thence continuing along a fence NE49°20’35” 104.57 feet; thence continuing along a fence NE23°04’00” 69.51; thence continuing along a fence NW00°05’49” 56.22 feet to a point on the North boundary of the NE1/4SW1/4; thence along the North boundary SE89°06’52” 613.21 feet to the TRUE POINT OF BEGINNING.

Section 24:  N1/2SE1/4, S1/2NE1/4 and all that part of the SE1/4NW1/4 and NE1/4SW1/4 which lies East of the right of way of the Wyoming division of the Colorado and Southern Railroad.

The above sale will be conducted by the Sheriff or the Sheriff’s deputy at the front door of the Platte County Courthouse in Wheatland, Wyoming, at 10:00 a.m. on Thursday, August 22, 2019.

In the event that either a representative of the Mortgagee or a representative of Premier Title Company is not present at the sale, the sale will be postponed until a later date.

Lana S. Shepard, Trustee for the Robert F. Shepard and Lana S. Shepard Living Trust dated November 15, 2013, defaulted on the terms of the Note and Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of $40,184.59.  

    The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.
