NOTICE IS HEREBY GIVEN pursuant to WYO. STAT. §§ 34-4-101 through 34-4-113, a certain Mortgage dated June 3, 2015, which was executed and delivered by Twiford Enterprises, Inc., a Wyoming corporation, Mortgagor, to Rolling Hills Bank & Trust, and later modified through that certain Modification of Mortgage dated March 13, 2017, will be foreclosed by a sale to the highest bidder at a public auction of the premises described pursuant to a power of sale contained in the Mortgage.  If you wish to contest said sale, then you must challenge said sale by filing a lawsuit in a court of competent jurisdiction. 

Mortgagor, Twiford Enterprises, Inc., granted Mortgagee, Rolling Hills Bank & Trust, two (2) separate Mortgages, both dated June 3, 2015 and both modified on March 13, 2017.  Mortgagee, Rolling Hills Bank & Trust, now seeks to foreclose the second or Junior Mortgage referred to above.  The Junior Mortgage was filed for record on June 3, 2015 as Document No. 631383 in Book 497 at Page 358, in the office of the Recorder of Deeds, Platte County, State of Wyoming.  The Modification of the Junior Mortgage was filed for record on March 24, 2017 as Document No. 648902 in Book 510 at Page 178, in the office of the Recorder of Deeds, Platte County, State of Wyoming.

The Junior Mortgage being foreclosed states a maximum face value loan amount of $3,870,000.00; however, the Junior Mortgage being foreclosed, together with the Senior Mortgage of the same date secure multiple promissory notes in excess of $5.4 Million.     

The premises that are described in the Mortgage are as follows:

Section 20: N1/2, SW1/4, N1/2SE1/4
Section 21: SW1/4NE1/4, W1/2SE1/4, S1/2SW1/4, NE1/4SW1/4, NW1/4
Section 28: W1/2, W1/2E1/2
Section 29: NE1/4, N1/2NW1/4, N1/2SE1/4
Section 32: E1/2NE1/4, NE1/4SE1/4 EXCEPTING THEREFROM land conveyed to STS Investment Co., Ltd, a Limited Partnership Agreement and James A. Ludvik, a Colorado resident by Corrected Warranty Deeds recorded April 19, 2011 in Book 461, Pages 1 and 4.
Section 33: W1/2NE1/4, NW1/4, NW1/4SW1/4, S1/2SW1/4, a portion of the NW1/4NE1/4SW1/4, more particularly described as follows:

Beginning at the Southwest corner of the NE1/4SW1/4; thence North on the West boundary of the NE1/4SW1/4 to the Northwest corner thereof; thence East on the North boundary of the NE1/4SW1/4 to the Northeast corner; thence diagonally South to the Southwest corner to the point of beginning.

The above sale will be conducted by the Sheriff or the Sheriff’s deputy at the front door of the Platte County Courthouse in Wheatland, Wyoming, at 10:00 a.m. on Thursday, March 8, 2018.  In the event that either a representative of the Mortgagee or a representative of First American Title is not present at the sale, the sale will be postponed until a later date.

Twiford Enterprises, Inc., a Wyoming corporation, defaulted on the terms of the underlying Notes secured by the Junior Mortgage, and as of the date of this Notice, the undersigned claims an outstanding balance of $5,425,890.65.  Interest continues to accrue on the unpaid balance at the rate of $2,631.37 per day.

The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.
